Acceptance of Terms

By accessing or using www.moorefarmherbs.online (the “Site”) to browse or purchase products, you agree to be bound by these Terms & Conditions (“T&C”) and all applicable laws and regulations. If you do not agree with any part of these T&C, you must not use the Site.

Eligibility & Account Registration

  • Eligibility:

    • You must be at least 18 years old and have the legal capacity to enter into contracts in your jurisdiction to place orders on our Site. By using the Site, you represent and warrant that you meet these requirements.

    • In the event that a product is mispriced or contains an error, we reserve the right to correct the error, charge the correct price, or cancel your order and issue a full refund.

    • All prices listed on the Site are in U.S. dollars (USD) and are exclusive of sales tax and shipping fees (unless otherwise specified).

    • Sales tax is calculated based on the shipping address you provide.

Order Acceptance & Payment

    • Placing an order online constitutes an offer to purchase. We reserve the right to accept or decline your order for any reason, including but not limited to:

      • Product unavailability

      • Errors in product description or pricing

      • Suspicion of fraudulent activity

    • You will be notified by email if your order is canceled or modified.

    • WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

  • TO THE FULLEST EXTENT PERMITTED BY LAW, MOORE FARM HERBS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR PURCHASED PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Indemnification

You agree to indemnify and hold Moore Farm Herbs, its officers, employees, and agents harmless from any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:

  2. Your violation of any applicable law or third-party rights.

  3. Your use of the Site or any products for unintended or prohibited purposes.

Governing Law & Dispute Resolution

  • Governing Law:

    • These T&C and any disputes arising hereunder shall be governed by and construed in accordance with the laws of the State of New Hampshire, without regard to its conflict of laws principles.

  • Venue:

    • Any legal action or proceeding arising out of or relating to these T&C may be brought exclusively in the state or federal courts located in Belknap County, New Hampshire.

Changes to Terms & Conditions

Moore Farm Herbs reserves the right, at our sole discretion, to modify or replace these T&C at any time. If a revision is material, we will provide at least 30 days’ notice on our Site before the changes become effective. Your continued access or use of the Site after those revisions become effective constitutes your acceptance of the revised T&C.

Severability

​If any provision of these T&C is held to be invalid or unenforceable, that provision shall be deemed stricken and the remaining provisions will remain in full force and effect.
